elayaluxe.com is a catalogue and enquiry website operated by ElayaLuxe, Surrey, BC, Canada. Products displayed are offered on a price-on-request basis; no purchase can be completed through this website. Submitting a pricing or custom request does not create a contract of sale: all sales are concluded directly between you and ElayaLuxe by phone, email or in person.

Accuracy of listings

We work hard to describe every piece accurately. Specifications marked "Call for Enquiry" are confirmed at the time of quotation. Images are illustrative; the exact watch or jewellery piece quoted to you will be confirmed with its own photographs and specifications before sale.

Quotes and pricing

Every piece is quoted individually, because the market for luxury watches and precious metals moves daily. Unless your written quote says otherwise, a quote is valid for seven days from the date we send it. Quotes are in Canadian dollars and exclude applicable taxes, duties and shipping unless stated. A quote is an invitation to proceed rather than a reservation: a piece stays available to other clients until payment is received and confirmed. We may correct an obvious error in a quote or a listing at any time before a sale is concluded.

Payment and title

Accepted payment methods are confirmed with your quote. Title passes to you when we receive payment in full in cleared funds, and risk passes on delivery. We may ask for government-issued identification and proof of address before completing a transaction, which is ordinary practice in this trade.

Authenticity

Every watch and every piece of jewellery we sell is inspected and authenticated by our specialists before it is offered, and we guarantee its authenticity for as long as the original purchaser owns it. If a recognised independent authority, an authorised service centre for the brand, or a qualified independent gemmological laboratory determines in writing that a piece we sold is not genuine, we will refund the full purchase price when the piece is returned to us. This guarantee is personal to the original purchaser and does not cover damage, alteration, unauthorised service, or parts replaced after delivery.

Condition of pre-owned pieces

Unless a piece is described as unworn, it is pre-owned and may show signs of prior wear consistent with its age and use. We describe condition honestly and provide photographs of the actual piece before any sale. Box, papers, spare links and accessories are included only where we state so expressly.

Custom and made-to-order work

Custom work begins once you have approved a design in writing and paid a deposit, ordinarily fifty percent of the agreed price, with the balance due before delivery. The deposit covers materials and reserves workshop time, and it is non-refundable once production has begun. We will not start production without your written approval. Timelines we give are good-faith estimates. Custom, engraved, resized and specially sourced pieces are final sale, which is standard for made-to-order goods.

Buying, trading and sourcing

When you sell or trade a piece to us, you confirm that you are its lawful owner, that you have the right to sell it, and that it is free of any loan, lien, security interest or other claim. We require government-issued identification for every purchase and every trade, and we keep a record of the transaction. Offers are made after physical inspection and authentication and are valid for the period stated in the offer.

If a piece is later found to be stolen, subject to a claim, or materially not as described, the transaction is void. We will cooperate fully with law enforcement and with any lawful owner, and you agree to repay any amount we paid you.

Sourcing a piece we do not hold is an undertaking to search on your behalf, not a guarantee of supply. There is no charge for asking, and nothing is owed unless a piece is secured and you accept it.

Trademarks

ElayaLuxe is an independent dealer and is not an authorized dealer of, or affiliated with, Rolex SA, Patek Philippe, Audemars Piguet, Cartier, Omega, Richard Mille, Vacheron Constantin or any other brand shown. All brand names and trademarks remain the property of their respective owners and are used for identification only. Manufacturer warranties may not apply; any warranty offered is provided by ElayaLuxe directly and stated at the time of sale.

Limitation of liability

Website content is provided as is, without warranties of any kind. Nothing on this site is investment advice, and the resale value of any piece may rise or fall. To the fullest extent permitted by law, our total liability arising out of any sale is limited to the amount you paid for the piece concerned, and we are not liable for indirect or consequential loss, including loss of profit or loss of value.

Nothing in these terms limits liability for fraud or fraudulent misrepresentation, or any liability that cannot lawfully be limited, including your rights under the Business Practices and Consumer Protection Act of British Columbia.

Changes to these terms

We may update these terms from time to time. The version published on this page when you submit a request is the version that applies to that request.

If part of these terms does not apply

If any provision of these terms is found to be unenforceable, the remaining provisions stay in full force.

Governing law and disputes

These terms are governed by the laws of British Columbia, Canada. If a dispute arises, both sides agree to try in good faith to resolve it directly first, and otherwise to bring it before the courts of British Columbia.
